Board of Works finds property owner in violation of city ordinance

GOSHEN — Goshen Board of Public Works and Safety members Monday threatened possible litigation against a local property owner regarding the condition of a house.

The home is located in the 100 block of 22nd Street, and the property owner has been found to be in violation of the city’s Neighborhood Preservation Ordinance.

The board was told by a Goshen Building Department staffer that the property at 115 N. 22nd St., Goshen, owned by Ronald E. Davidhizar, was first inspected in July of 2012. The inspection yielded several violations of the Neighborhood Preservation Ordinance.

Davidhizar was given 30 days to make the necessary repairs to the property, and in a following inspection on Aug. 7, 2012, it was found that two of the three items listed as violations had been repaired, with only the repainting of the house, overhang and facia left to be completed.

Subsequent inspections were then completed on Aug. 24, 2012, Dec. 3, 2012, and July 3, 2013. All three showed no significant improvement to the paintwork, Board of Works members heard Monday.

The board, following a hearing on the subject Monday, voted to give Davidhizar until Wednesday to complete the required repainting of the house, overhang and facia. Should Davidhizar fail to complete the repairs by that deadline, city attorney Larry Barkes said, city officials will likely seek legal action to get the issue resolved.

Other business

In other business, the board:

• Approved the hiring of Peerless-Midwest to perform the city’s annual well and pump inspection at a cost of $4,950. The contract will involve the inspection, testing and servicing of the wells and pumps at the North Water Treatment Plant, Kercher Water Treatment Plant and Hilltop Booster Station. Work on the project has a completion date of Dec. 31, 2013.

• Approved a request by Eric Kanagy of Pizzeria Venturi LLC to block one parking spot on East Lincoln Avenue in front of the Venturi building for one week in October or November to allow for the removal of trash from the building.

• Accepted the plat for the Park West 7 Subdivision, a seven-lot residential subdivision zoned Residential-1 Planned Unit Development, located east of Greene Road on the south side of Park West Drive and the west side of Pringle Drive.

• Approved an change order to a previous agreement between the city and Mike’s Masonry Inc. for an additional $1,800 for repair work to the chimney at the Goshen Water Department, 308 N. Fifth St., Goshen.

• Approved a request by Jerry Nofziger of Goshen Antique Mall to place a dumpster along the building at 111 S. Main St., Goshen, for 10 days beginning approximately Oct. 15 to allow for the replacement of a small section of shingles on the building’s roof.
