Board wants Goshen restaurant to comply with sewer ordinance


GOSHEN — A Goshen restaurant has been ordered to comply with an ordinance requiring a grease interceptor or a grease trap be installed in its sewer line.

On March 4, Timothy Huser, on behalf of the County Seat Cafe`, appealed the installation requirement of a city ordinance and requested to install a mechanical grease trap instead of the grease interceptor, Goshen engineer Dustin Sailor said.

The board approved the request with the grease trap installation to be completed by May 31.

“No mechanical grease trap has been installed,” Sailor said, during a public hearing at the Goshen Board of Public Works and Safety meeting Monday afternoon. “It is the last restaurant to be under compliance.”

All city restaurants were supposed to be in compliance with the requirement by Dec. 31, 2012, according to Sailor.

The board authorized city attorney Larry Barkes to proceed with whatever action is needed to bring the restaurant into compliance with the ordinance, said Mayor Allan Kauffman, who is a board member.

Kauffman asked if Huser or any other representative of Maple Leaf Ventures Inc. was in attendance at the hearing. No one stepped forward.

Project costs down, up

There was good news that came in the form of a request from the Goshen Engineering Department for a change order associated with the Monroe Street water main relocation project.

“The work is complete. A balancing change order is being presented for a net construction cost decrease of 14.39 percent,” Sailor said. “With construction adjustments, the contractor and staff were able to trim the project cost from $63,078 to $54,002.”

In not so good news, an additional change order was requested by the Engineering Department involving a contract increase for the Central Garage expansion project. The change order marks the fourth for the project to date, for an increase of 5.3 percent.

The change order includes the labor and materials for a gate opener and to furnish and install a 500 gallon oil separator for a cost of $8,628. According to Sailor, the total contract price is now $779,468.20.

Other business

In other business, the board approved:

• The contract bid from Kibby Excavating Inc. of $9,200.59 for the owners of The Electric Brew to pursue a curb bump-out project at their new location at 118 E. Washington St.

• For J & K HVAC Service to close both of the east bound lanes on West Lincoln Avenue in front of the 1st Source Bank Building from 8:30 a.m. for three hours Aug. 28. The closure is needed due to a crane lifting a 15-ton condensing unit on top of the building and removing the existing unit.

• The Fraternal Order of Police Lodge 81 closing a half block of Summer Avenue and Harrison Street between 10 a.m. and 11 p.m. Saturday for the associate’s/community banquet at the VFW, 1201 W. Pike St.

• A contract with Nuway Construction Corp. to repair roof beams in the city’s Annex Building to help stop water leaks. The cost will be $1,604 and the work will be completed within 30 days.

• Elkhart County Highway Department giving the city a radio signal booster. The city’s legal department asked to contract with Emergency Radio Service Inc., to remove the signal booster from a Middlebury tower site and reinstall it at the Goshen Police Department and integrate it at the county’s 911 site for the city’s operation. The cost will be $3,676 for labor and materials.
