GOSHEN BOARD OF WORKS: Rental properties found to be out of compliance

GOSHEN — GOSHEN — Two rental properties were found to be out of compliance with city regulations Monday afternoon.

The Goshen Board of Public Works and Safety ruled that rental properties owned by Jared and Kaylene Yoder of Goshen, at 302 E. Lincoln Ave. and 408 E. Lincoln Ave., had several violations of city code.

The Yoders did not appear at the public hearing to discuss the alleged violations. The board ruled that the building commissioner’s finding that 408 E. Lincoln Ave. needs roof shingles replaced, insects exterminated and a guard rail by the front door replaced, was proper.

The board also ruled the building commissioner was right to find that the property at 302 E. Lincoln Ave. needs deck boards replaced; indoor furniture removed from a porch; electrical outlets repaired; a sink drain opened, a tub drain leak fixed; a hot water heater repaired; smoke detector batteries replaced; and a replacement for a missing smoke detector.

The next step is for the property owners to resolve the issues with the building department personnel.

In other matters the board:

• Promoted Goshen Firefighter Jeremy Johnson to the rank of sergeant.

• Agreed to acquire right of way on four properties along Monroe Street for a bicycle/pedestrian trail from Madison Street to the county fairgrounds.

The owners of the parcels are OmniSource Corp., the Elkhart County 4-H and Agricultural Exposition Inc., Glendon and Lorna Bender, and Beverly Lemler. Total cost of the acquisitions is $96,775. The pathway is a federal-aid project.

• Rejected bids to replace windows at the water and sewer department. The board later approved a contract with Quality Glass of Goshen to replace seven windows at the wastewater treatment plant at a cost of $9,460.

• Approved a mechanical license request for Robert Howey of Hoosier Refrigeration Inc. of Fort Wayne.

• Gave Forest River an exemption to city parking lot code. Forest River will be allowed to create a gravel-surfaced parking lot next to a new plant. Code requires a paved parking area unless the board finds there are other unpaved parking lots in the area. The board determined the company has several gravel parking lots at its plants along Century Drive and the new lot would fit the standard already present.

The board also gave Forest River permission to connect a sanitary sewer for the new plant in the Century Drive Industrial Park to an existing sanitary manhole. The manhole will be modified to accept the line and it will be fenced and an easement will be created to allow city workers access for maintenance.

• Gave Rick Frey permission to place a new sign for Frey Furniture Restoration, 906 Chicago Ave., in the city right of way.

• Gave Yaw Construction permission to block four parking places in front of 104 and 106 N. Main St. so underground vaults can be filled in.

• Discussed with Robert Allberry, owner of Dandino’s Restaurant, options for installing a 1,000 gallon grease trap as required by city code. The business does not have enough room on the property to install the large underground tank, so the board granted Allberry permission to use city right of way. In the future, if the city requires the grease trap to be moved because of utility or road work, the city will pay that cost, according to the board.

• Gave Tim Miller relief from his sewer bill. Miller told the board he will be filling a swimming pool with 25,500 gallons of city water and asked not be charged for the sewer portion of the water usage.

• Approved health insurance participation agreements for city employees. The insurance policies will be through Central States and Southeast and Southwest Areas Health and Welfare Fund. The maximum cost per employee for 2013 will be $297; for 2014 $327; and beginning Jan. 4, 2015, $360.

• Amended how storm water fees will be calculated. Like Elkhart County, the city will now use the county’s latest aerial photography maps to help calculate which properties will be assessed.
